Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Nevermind Software, LLC (“Nevermind”, “we”, “us”) covering your use of the past lives iOS app (the “app”). By downloading or using the app you agree to these Terms. If you do not agree, please do not use the app.

1. What past lives is

past lives is a viewer for the Live Photos already in your Apple Photos library. It runs entirely on your device: there are no accounts, no Nevermind servers, and no online features. How the app handles your data is described in our Privacy Policy, which is part of these Terms.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices that you own or control, as permitted by the App Store terms. You may not copy, modify, distribute, sell, rent, or reverse-engineer the app, or create derivative works from it, except where the law expressly allows.

3. Your photos

Your photos and videos are yours. We claim no ownership of or rights in them, and because the app processes them only on your device, we never receive them.

The app changes your photo library only when you ask it to, by marking a Live Photo as a favorite or deleting it. Deletions go through Apple Photos and, like deletions made in the Photos app, may be recoverable for a period from the Recently Deleted album; after that they are permanent. You are responsible for keeping backups of your library and for anything you choose to share from the app.

4. Acceptable use

Use the app only as intended and in compliance with applicable law and Apple’s App Store terms. Do not interfere with the app’s operation, attempt to circumvent its protections or those of the operating system, or use it to infringe anyone’s rights.

5. Apple

The app is distributed through the App Store. These Terms are between you and Nevermind, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claim relating to it, including product liability, legal or regulatory compliance, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where Apple’s standard Licensed Application End User License Agreement applies, it governs any matter these Terms do not address.

6. Changes to the app

We may update, change, or discontinue the app or any of its features at any time. An update may be required for continued use.

7. Disclaimer of warranties

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free or uninterrupted, or that it will preserve your photos. Keep backups.

8. Limitation of liability

To the fullest extent permitted by law, Nevermind will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data (including photos), arising out of or relating to the app, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid for the app and ten US dollars (USD $10). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Termination

You can stop using the app at any time by deleting it. We may end your license if you breach these Terms. Sections 3, 5, 7, 8, and 10 survive termination.

10. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute relating to the app or these Terms will be brought in the state or federal courts located in New York City, New York, and you consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. The effective date above shows when they last changed. Continuing to use the app after a change means you accept the updated Terms.
